In brief

Mahmoud Khalil, a pro-Palestinian activist and legal U.S. resident, faces deportation as he appeals a federal court decision initiated by the Trump administration. His case raises critical questions about free speech and the government’s stance on activism related to Palestine. Khalil's lawyers argue for his rights to advocate, while the government maintains its deportation efforts.

NEW YORK (AP) — Mahmoud Khalil appeared before a federal appeals court in Philadelphia, continuing his legal fight against deportation initiated by the Trump administration due to his pro-Palestinian activism at Columbia University.

The session at the 3rd Circuit Court of Appeals comes as federal authorities seek to overturn a lower court order that allowed Khalil's release from an immigration detention facility in Louisiana in June. Khalil's lawyers are advocating for the preservation of his legal status, arguing against further detention or deportation initiatives.

Government attorney Drew Ensign argued that a lower court ruling overstepped its boundaries, insisting that the matter is appropriate for an immigration judge in Louisiana to resolve. Ensign stated, “All of this is being conducted in an improper forum.”

An immigration judge had earlier ruled in August that Khalil could be deported, although that decision is now under review by a separate immigration appeal board.

Khalil, who is married to a U.S. citizen and has voiced his determination to continue advocating for the Palestinian cause, recently received permission from a magistrate judge to travel for various events across the United States.

“They want to make an example of me to intimidate those speaking out for Palestine across the country,” Khalil stated after the recent court hearing. He affirmed his commitment to fighting for free speech rights in federal courts, stating, “I will continue my legal fight for my rights, and for everyone’s right, to free speech.”

Khalil was notably the first individual arrested in the Trump administration's extensive attempt to deport activists and academics engaged in pro-Palestinian demonstrations, which the government has described as antisemitic. Khalil has firmly rejected these allegations.
