In brief

Judicial intervention has unblocked important federal climate funds, reinstating financial support to nonprofit groups, despite ongoing disputes with the Trump administration.

In a significant legal development, two federal judges have ruled to unfreeze hundreds of millions of dollars in federal climate funding that had been denied to nonprofit organizations under the Trump administration. The rulings represent a victory for these groups in their ongoing struggle for access to financial support intended for climate initiatives.U.S. District Judge Tanya Chutkan of the District of Columbia has ordered the immediate release of up to $625 million in climate grants, which had been stalled since mid-February under the Biden administration's $20 billion Greenhouse Gas Reduction Fund, also referred to as the "green bank" program. This funding is closely associated with efforts to combat climate change through various environmental projects. In a separate ruling, Judge Mary S. McElroy from the District of Rhode Island mandated that five federal agencies restore their environmental and infrastructure funding that had been awarded to nonprofits. Judge McElroy highlighted that the freezes imposed by the Trump administration were “neither reasonable nor reasonably explained” and expressed confidence that the nonprofits could prove the levies were “fundamentally arbitrary.”These lawsuits are part of a broader challenge against the Trump administration, which has sought to freeze billions of dollars of funding sanctioned through two major bills passed in 2021 and 2022: the Infrastructure Investment and Jobs Act and the Inflation Reduction Act. Although various judges have compelled the administration to release the funds, officials have countered that the pauses were necessary to comply with the executive orders issued by President Trump since taking office.
